Research And Application Of Enterprise Trademark Infringement Monitoring And Early Warning System

Under the new economic situation, the global market economy gradually from the competition of enterprises' products and owned technology to brand competition. Enterprises take advantage of technology and knowledge to develop brand. Now, trademark not only ifself has value, but also can create value. Under the huge economic interests driven, trademark infringement phenomenon intensified. Once a trademark was infringed, the enterprise will face huge losses. And for avoiding or reducing the risk of infringement, the enterprise should better control it before that happened, namely to establish trademark infringement monitoring and early warning system, and take control measures timely. Therefore, this paper puts forward the thrademark similarity calculation method and monitoring and early warning analysis method, and constructs a trademark infringement monitoring and early warning prototype system, to help enterprises to avoid trademark infringement disputes. The main contents of the article include the following aspects.Calculate trademarks similarity. Trademark similarity is the core of determine whether the brand infringement. Only if similar trademark may cause confusion, infringement risk may occur. Chinese trademarks and graphics trademarks were studied deeply in this article and presents Chinese trademark semantic similarity calculation and graphic trademark similarity calculation method. We used two methods respectively computing graphic trademarks from the overall and local similarity for fully considering the laws of trademark infringement.Analyze trademark infringement risk. This part firstly build a mechanism of risk identification, and then determine warning degree and policy according to experts, infringement cases analysis and obtained results. Finally, analyze this risk of trademark and idnetify where the risk comes from, and give control scheme for all levels of risk.Implement and apply prototype system. We construct the enterprise trademark infringement warning prototype system the proposed algorithms and infringement analysis method. To prove the methon's effectiveness, we select some infringement cases as trademarks to be analysed. And find out infringement risk trademarks from trademark datas using the system. Finally, give a solution to control the risk.
