Study On Supervision Of Product Quality Law Enforcement

Product quality is not only a measure of a country's economic competitiveness and an important indicator of the level of development, but also reflects the important reference to the people's living standards. Especially in modern society, with the rapid development of the economy, the society and the continuous improvement of people's living standards, the status of the quality of products has become increasingly prominent.China is now in a critical period of economic transformation and upgrading, the original extensive type, by expanding the amount has encountered bottlenecks. The production of high-quality products, relying on quality to win has gradually become the consensus.But in recent years, product quality problems emerge, seriously affected the international reputation of domestic brands, against the legitimate rights and interests of consumers and consumer confidence, the quality of unsatisfactory administrative law enforcement is one of the important reasons. Clean and efficient administrative enforcement is of great significance to foster and create a favorable market environment and product quality, promote quality and efficiency, the transformation and upgrading.Furthermore, good administrative law enforcement supervision system can contribute effectively to the administrative law enforcement work carried out in accordance with regulations, which is of great value function to improve product quality,as well as national law government economic and social development.However, our current quality of administrative law enforcement supervision system still has many problems. Such as unreasonable product quality supervision and administrative law enforcement system, imperfect legal system, poor environmental law enforcement and supervision and so on. These problems, making the product quality law enforcement susceptible to interference from all sides, are in particular the implementation of easy-aliasing.In view of the problems existing in the product quality of administrative law enforcement and supervision system of our country, the following five aspects should be improved : First, to strengthen and improve the quality of administrative law enforcement supervision legislation. After full argument of the case, to advance the development of "administrative supervision", and to strengthen the scientific and democratic legislative process, to support the further refinement of oversight of laws and regulations. Second, to strengthen product quality supervision and administrativelaw enforcement personnel qualification management, to improve law enforcement incentives and accountability mechanisms. Third, at the same time to strengthen the supervision over administrative enforcement process and results, and to enhance the timeliness and effectiveness of supervision. Fourth, the establishment of a unified and coordinated law enforcement supervision system, to prevent duplication supervision or oversight gaps and the like. Finally, to focus on strengthening the convergence of the administrative law enforcement and criminal justice,to aim at strengthening judicial supervision. Sought by building a sound legal system, which is consisted of internal and external oversight, process monitoring and supervision combined result, reasonable division of labor, smooth channel, efficient product quality law enforcement supervision system, China's product quality strategy will be boosted steadily and effectively.
