The Research On The Petition Work Of Quanzhou City

In China, Petition is a kind of expression of public opinion. Petition work is a complex task, involving all aspects of the country's political life. Petition has been seen as a shortcut to resolve conflicts and disputes between the masses and the government, and in order to meet the masses, the current petition institutional mechanisms hope to pay as little cost as possible and quickly solve the problem of demand. Quanzhou is a private economy developed coastal cities, the petition issues have highlighted year after year. County and township government take a lot of petition tasks, but the more petition resolved, the more problems appear, especially petition backlog and leapfrog petition. Because of leapfrog petition issues related to the level of social stability, stability controlling and persuading the leapfrog petitioners become the political mission of the primary government. Once the leapfrog petition problem can't be solved, petition stability controlling of staff become routine work of some township cadres.After careful analysis, the main reasons for this situation include: the people believe the petition but don't believe law, with respect to administrative and judicial remedies, masses are more willing to reflect the demands by petition to seek to solve the problem; improper performance appraisal system and the higher the pressure, the higher institution demand the executive branch and the basic government to resolve the problems and control petitioner to be stable level by level; the petition system and mechanism is not suitable, and the problem handlers unreasonable, some of the petition issues are difficult to be resolved between the executive branch and the basic government; the petition departments' power is weak while responsibilities are heavy, and it is difficult to organize, coordinate, supervise many problems related administrative functions.This paper will strictly distinguish petition relief, judicial remedies and administrative relief, and spin non-petition problems out from petition settlement procedures. Then, establish petition work performance appraisal system which is reasonable and rightful, and put forward opinions and suggestions combining government performance management theory and the theory of civil rights remedies.
