At present,our country is in the high-speed development period of Internet economy.All kinds of new type Internet consumption patterns have sprung up like mushrooms,one of them is reward-based crowdfuding.Reward-based crowdfunding is famous in the world rapidly by its characteristic of low barriers to entry,wide scope and investment is convenient.But there is also a hidden danger in the rapidly development,this is the reward-based crowdfuding the risk of default.Once the participant of crowdfunding appears the situation of default,always cased the widespread influence,to bring huge losses to observant party.At the same time,due to the field of reward-based crowdfuding system is not perfect,leads to after the defaults,default party is hardly to finded out there duty and the responsibilities is uncleared.This phenomenon is a serious impediment to product the development of the reward-based crowdfuding industry.In this paper,through the concrete of analysis,demonstrates the reward-based crowdfuding each participation should had the rights and assumed the obligations,by the operation mode of reward-based crowdfuding.And on this basis,discussed the reward-based crowdfuding possible cased of breach of contract and should bear all the responsibility.Finally based on the product of the reward-based crowdfuding,in the default time appear problem,proposed the rationalization proposal.This article is divided into three main parts:The first part outlines the fundamental questions in the reward-based crowdfuding.Firstly,this part introduced the concept and current situation of the development of reward-based crowdfuding;Secondly,I summarized the operation mode of reward-based crowdfuding through the cases;Finally,I introduced the value of reward-based crowdfuding.The second part analyzed the basic questions in the liability for breach of rewards-based crowdfunding.Firstly,I introduced the concept and characteristics of Liability for Breach of Rewards-based Crowdfunding.Then I focus on each participants who had the right and should the burden of duty in the Rewards-based Crowdfunding.The third part discussed each participants in the rewards-based crowdfunding which may occur the default situation,and analyzed the default party should bears responsibility in these situation.The last part advised how to perfect the system of reward-based crowdfuding in our countries.First of all,we should cleared out the responsibility of crowdfuding platform;Secondly,I advised to built the a security system;Finally,I suggests that the crowdfuding contract should be urgently named.To sum up,this paper through the reward-based crowdfuding of the concrete analysis,trying to solve the reward-based crowdfuding responsibility of default of contract is not clear,hard to get account,and give some advises to research the reward-based crowdfuding in our countries.It is good for this fields developments.
