Due to improper use of guns by the police in the practice, cases involving infringement of citizens' rights have often occurred, while the police did not dare to use the gun to cause unnecessary police casualties is common.The existing program rules in police shot is broken by this text which restore the real case as the breakthrough point,takes example by the advanced experience from abroad,comprehensively uses the case analysis method,comparison method,and comprehensive analysis to explore the application for perfecting our country the use of guns by police, in order to maximize the play to the advantages of the police use of firearms to protect citizens' legitimate rights, at the same time establishing the image of the police and the authority of law.The primary task of the police shot is against the criminals at the first time in the state of emergency to safeguard the safety of people's lives and property, and maintain social stability, but at the same time, there are a series of problems with the shooting,the police shot is reasonable or not, whether to comply with the shooting program, the public's right to know after the event, the process after shooting and so on,so there are many problems about police shooting to be exposed in the current context of risk society.The first part mainly explains the real situation of the use of guns by police in our country.The related rights of the police need to be further expanded in the context of risk society,but the right can not be abused,therefore it is very important to study the expansion of police power in a reasonable range to improve the procedure stipulation of police shooting.So the second part will focus on what degree the police authority should be.Guns are compulsory means the maximum intensity in the police authority, now in our country regulations on control of guns are mainly included in The People's Police Use of Weapons and Equipment Regulations, which has set about the police opened fire conditions, the preceding provisions of the police shooting, police verbal process,the police shot program and processing regulations after shot by police are not perfect, as to police is difficult to operate and judge the shooting in the practice,leading to the task failed, and causing public questioning. To cure the above problems, the United States and Hongkong more mature experiences can be learned, combined with our own actual situation, and constantly improve the people's police use of firearms and reasonable application.After the analysis of the difficulties faced by the police use of firearms, direction of development should be and combined with foreign experiences, summed up a series of suitable procedures for our country's police shot within the actual situation. The author thinks that improvement in the prepositional procedure of police officers with guns, in standard verbal warnings and shock program to strive to reduce fire frequency and fight crimes; secondly, regulating the gun condition standard which try to be refined and incorporate the conventional conditions into the police ordinance to reduce self judgment time for a race against time to stop crime and formal gun procedures, improving drawing the gun and shooting procedures; once again completing post-incident report and inquisitorial procedures,the protection after firing,report in time, crime scene investigation and so on; finally, further through the improvement of communication with the media system, the psychological guidance after shooting etc to improve the police shot program. In addition, this article will explore the substitution effect on non-lethal weapons,so in the near future our country police will also apply non-lethal weapons against more criminal offenders. |
