On The Legislative Perfection Of The Supervision System Of The Unified Transaction Of Public Resources In China

In order to prevent corruption from the source,the protection of the public resources are not wasted,to avoid loss of public resources become offenders in exchange for profits,protect the market order,the general office of the State Council issued "the build plan of public resources trading platform",together with the national development and Reform Commission issued "Interim Measures for the ministries of public resources trading platform management." This scheme is to change the existing public resources trading mode,will be transformed into a centralized transaction of public resources,on the one hand,to reduce unnecessary consumption of public resources,but also reduces the transaction cost,the actual benefit.This scheme is to change the existing public resources trading mode,will be transformed into a centralized transaction of public resources,on the one hand,to reduce unnecessary consumption of public resources,but also reduces the transaction cost,the actual benefit.In this paper,through the analysis of domestic public resources trading supervision of relevant laws and regulations and implementation of regional supervision of public resources trading situation investigation,depth analysis of China's public resources trading regulatory basis,subject,methods,procedures and other aspects of the problems,and the resulting social public resources and may cause the problem of corruption.On the basis of this analysis,the corresponding supervision mode of the developed countries in the international public resources trading is analyzed,which is a feasible reference for the improvement of the existing supervision mechanism.Finally,put forward specific measures to improve the supervision system of China's Public Resources Trading: the establishment of a unified,independent supervision mechanism and professional supervision mode,and will be the basis for supervision by the department regulations to improving the effectiveness of legal effect,promote public resources trading supervision and management of separate legislation,the abolition of the original relevant repetition law,make the city,all over the country territory,relevant ministries to implement a unified regulatory procedures,effectively accomplish decision-making,execution,supervision and separation,improve regulatory effectiveness.
