Research On The Practiacl Problems And Countermeasures Of Forensic Expertise In China

Judicial expertise is an important form of legal evidence,scientific and justice is the necessary condition for the realization of its functional value,but also the foundation of its activities.Because in our country in judicial practice such as "re identification start at random","identification standards are not unified,identification procedures is not final","subjective appraisal personnel","expert opinion especially the medical fault liability degree identification has great regional differences" and so on.Seriously affect the objectivity and fairness of judicial expert opinion,seriously weakened its function value and life basis.To solve these problems,we should improve the relevant legislation,the unified national accreditation standards;establish expert system of integrity;the implementation of court testimony system of auxiliary expert system and judicial appraiser;the construction of Judicial Identification Expert Committee for final judicial departments;strengthen the government circulation coordination efforts,balance regional differences;strengthen supervision mechanism,the establishment of disciplinary measures.Only in this way can we guarantee the scientific nature and justice of the judicial expertise,so that the judicial authentication can realize its function value in the judicial practice.
