On The Actuality Of Judicial Expertise & Countermeasure In China

The dissertation contains four chapters. The first chapter is about the summary of judicial expertise (or forensic science).It expounds the basic theories of judicial expertise in compared the opinion ,the character and the example of continental legal system with common law ,which provides referential coordinate to reforming judicial expertise system in china.The second chapter is about the actuality of judicial expertise in china .On analysing the actuality ,problems and reasons of Chinese judicial expertise in details ,and discerning mistaken thoughts in the study of judicial expertise ,the author argues that reform of Chinese judicial expertise should improve its theory and system in the same time.The third chpater is about how to improve the basic theoretical system of Chinese judicial expertise.It discusses the new concept about Chinese judicial expertise ,the limited validity of expert conclusion and the standardization of expertise report from diffent aspects.The fouth chapter is ahout how to redesign Chinese judicial expertise system .It discusses the definiteness of expertized odject and area ,how to establish the strict system of fixed professional capacity of expert,the multiplicity of expertized institution and manageable mode ,the expert register system on basis of guild through the management of the people's court ,expertise motivating mainly through thepeople's court and secondly through the parties'application ,expert document mainly through cross-examined by the parties and secondly through expert giving testimony in court and through technological advisor securing .At last ,it is about how to establish the legal system of judicial review and scientific provement on expert conclusion .
