Study On The Challenge And Legal Suggestion To China Ship Registration Regulation Under The Condition Of International Financial Leasing

Currently, international financial leasing is one of the most important channels for purchasing the ship. Because the ship is value, needs a long time to finish and is diversity legal relationship, the buyer will face more problem and difficulties when using financial leasing to buy the ship. Now, the nations has different regulations for ship registration and the international legislation institution wants to make a uniform law to solute this problem, however, the result is not satisfied. That is the reason why this question has become the hot pot for the academy.There are not many research results in our country in the field of navigation and finance. And also there is no publication of financial leasing law. It is not evasion for the tendency of economic union, diversity and internationalize of the world. So it is the focus for us to explore a way of suiting our Chinese characteristic in the field of ship registration.The article has been divided into three parts, to issue the problem, to analyze it and solve it.The 1st part is to state current situation of ship registration in China, and narrate the meaning and content through jurisprudence and other legislations. The 2nd part is to analyze the strike and challenge when purchasing the ship with financial leasing.The 3rd part is to introduce legislation in developed countries, especially those in the field of maritime. The author has issued some legislative suggestions through combining with practice and legislative state.
