With the rapid development of China's economy,the water industry is also growing prosperity.However,greater interests causes more and more accidents.Nowadays,water settlements for accidents mostly in the form of civil or administrative ways.But due to the special nature of the aquatic environment,those are obviously not conducive to water transportation industry regulation.What's more,the water traffic often equals to a huge number of damages.In this case,if we want to build a comprehensive system of regulation,civil or administrative ways are not enough.Then criminal punishment comes to our mind,for it's strictness and effective measure.When it comes to settle the traffic accident,only "Criminal Law" provisions of Article 133 involved.But that article is inclined to road traffic,which couldn't solve the problems in water traffic properly.In practice,when dealing with water traffic accident crime,there will be many difficult problems.So setting an independent crime on water traffic is in badly needed.This thesis studies on the water incident of navigation:the first chapter introduces the the way that how our country dealing with the water incidents' in nowadays.And what kind of defects they will cause.Thus leads to set the criminal on water traffic urgently;the second chapter analysis on the necessity and viability on setting up the water traffic crime on water;the third chapter depicts the setting of the offense and try to make the charges conditions as clearly as possible;the fourth chapter,major to compare the familiar crime on different filed of traffic crime.In which way to make a clearer identification of this offense;the final chapter of this article,drafting the filing standards and punishment.To combined with the latest version of the Criminal Law amendment(ix),the water sailing crime should set more comprehensive perspective on the innovation settings--practitioners prohibits punishment.
