The Research On Legal Issues Of Emergency Mechanisms Of Chinese Sudden Water Pollution Incidents

In recent years, the frequent occurrence of sudden water pollution incident is damaging theecological environment and hindering the development of the economy which brought hugedisaster to people and country. Therefore, to strengthen the construction of emergencymechanisms of sudden water pollution incident and to study on how to deal with the sudden waterpollution incidents becomes particularly important.At present, study on legal problems of the emergency mechanism is still in the initial stagefor sudden water pollution events in our country; In the practice of coping with environmentalsafety requirements of development in the new era of serious discrepancies. Outstandingperformance as follows: Firstly, the legislation lag is obvious on sudden pollution incidentemergency response mechanism, operability is not workable. At present, the legal system ofChina’s sudden water pollution incident emergency mechanism is established by giving priority toConstitution, Emergency Response Law and Environmental Protection Law with the WaterPollution Prevention and Control Law, local regulations and rules as subsidiary,the legislation haspresented dispersivity. Secondly, emergency law enforcement law enforcement agency is notcoordinated, information disclosure is not timely, public participation is not mobilized whichaffect the relief. Thirdly, the ex post judicial accountability seems not completely, it lacks ofecological compensation mechanism.Therefore, we start from the social reality of the sudden water pollution incident response,analysis of legislation, law enforcement, and relief on sudden water pollution emergency responsemechanism omissions and explore similar foreign advanced experience of the system, trying to putsudden law value of the mechanism of onset Pollution Incidents as guidelines to seekimprovement and development of the legal norms of the sudden water pollution incidentemergency response mechanism, to achieve standardization and legitimation on sudden waterpollution emergency response mechanism.
