Social Power Theory And Its Value Of Improving Balances System Of State Power Of China

Chinese society is experiencing a transformation from the duality structure of State-Personal to the ternary structure of State-Society-Personal.The sign of this shift is the rise and development of social organizations.With this trend,the embryonic form of civil society in China is becoming more apparent.The foundation of social power is the formation of civil society.Social power refers to the power and influence to the state and society of social organizations with their possession of social resources.The subject of social power must be individuals with human rights and civil right or a group with common interests consisted of individuals.They should possess some social resources with which they can gain the influence and power to the state and society.State power comes from the social power,and social power is the foundation of state power.The relationship between them is management and supervision.Social power is essentially the integration and development of individual rights and a guarantee of realization of individual rights.They communicate and interact with each other by negotiation.Social power plays an important role in the supervision of state power.At present,anomie phenomenon is common in the exercise of China's state power.It causes great damage to the rights of the individual.Based on the analyses of the anomie phenomenon,we can find the theoretical and practical problems of the balance system of China's state power.In theory,the traditional theories of balancing state power by individual rights or state power cannot achieve the overall balance of the state power.In fact,the people's Congress's legislation and supervision power and the supervisory role of judicial power to the administrative power are not fully realized.The social supervision power is too weak,too.Social power theory can promote the subject structure of our country's balances of state power from the duality structure of State-Personal to the ternary structure of State-Society-Personal.Social power theory can expand the balances of state power outside the original system.Social power theory can also promote the balances system model from the static to the dynamic transformation.In practice,social power theory can guide the change of the government functions,transfer some government functions to the social organizations,promote social autonomy and realize the transformation from national power to social power.Social power theory will also promote social organizations to participate more in the processes of legislation,judicature and administration of state so as to check and influence the state power.
