Research On Legal Issues Of Antarctic Marine Protected Areas

Recently human has gradually deepened the exploration for the Antarctic gradually deepened,especially has increased the development and utilization of biological resources in the Southern Ocean,such as commercial fishing of Antarctic krill and toothfish.However,biodiversity in the Antarctic waters is threatened because of overfishing and even IUU fishing.In response to this challenge,CCAMLR,according to the Convention on the Conservation of Antarctic Marine Living Resources,adopted a series of conservation measures and established the Antarctic Marine Protected Areas.This is new development of the Antarctic marine living resources protection.Antarctic Marine Protected Areas are an important part of the network in the construction of the High Seas Marine Protected Areas,and involve the international governance of Antarctica and the Antarctic interests of China.The current domestic concern about that is not enough yet.So there is a certain research value.This thesis first introduces the definition and function of marine protected areas,and the significance of practice of marine protected areas in other areas to the Antarctic waters.Then it takes analysis of international law from global and regional perspectives,for the Antarctic marine living resources protection,the essence of Antarctic marine protected areas.Third,it focuses on two marine protected areas established in the Antarctic and provisions of general framework,combining law and practice.What's more,in international and Antarctic background,it looks forward to the prospect of Antarctic Marine Protected Areas.In view of enhancement of environmental and cooperative awareness,improvement the level of science and technology,more marine protected areas will be established in the Southern Ocean.China is an important member of CCAMLR and should play a more active and constructive role in the development of Antarctic Marine Protected Areas,and organically combines global environmental interests and national interests itself.
