Research On The Construction Of International Law System Of Transboundary Comprehensive Dispatching In Lancang-Mekong River Basin

The research on the legal mechanism of the Lancang-Mekong River has been a hot topic in academic circles.All this time,the basin countries have a clear interest game on how to utilize and protect the Lancang-Mekong River water resources,and can not achieve the whole basin cooperation because of the lack of mutual trust and the cognitive differences in the concept of water resources.Especially in view of many people,hydropower development and water ecological protection seems to have become a pair of irreconcilable contradictions.Due to a number of water technology and professional issues involved,it is difficult to find a breakthrough only in the discussion of international law.Taking into account the large regulated storage capacity in the basin,this paper introduces the concept of "river comprehensive dispatching" from the perspective of relatively neutral hydrotechnics.The cooperation mechanism constructed under this technical guidance will be the best way to achieve the optimal balance of the overall benefits of the whole river basin and the shared balance of the parties.This paper analyzes and envisages the legal cooperation mechanism on the cross-border integrated dispatching of Lancang-Mekong River.We hope that the existing problems can be solved through the interaction of technology and law.In addition to the introduction and conclusion,this paper consists of four parts.The first part introduces the natural conditions of Lancang-Mekong River and the current situation and problems of water resources utilization,and locates the consensus of water resources utilization and protection in the basin countries to find the basis of mutual trust in comprehensive and in-depth cooperation of river basin water resources.The second part is the feasibility study on the comprehensive dispatching of the Lancang-Mekong River.The research contents include the influence of international water law theory,the practice of river comprehensive dispatching,the planning and construction of basin water conservancy projects,the role of existing important river basin cooperation mechanisms,and the uncertainties caused by the relationship between external water politics and so on.The third part organizes the legal provisions and mechanisms for international cooperation on water resources that Langcang-Mekong river transboundary comprehensive dispatching can learn from.Due to the lack of sufficient authority of the current Mekong River Commission and the lack of effective functioning of the relevant agreements,it is necessary to gain experience from other relatively successful water management concepts,paths or patterns.The forth part tried to build a new Lancang-Mekong River Commission.Within this framework,dispatching requirements and legal issues are discussed in detail.Finally,this paper adjusts and innovates the organizational structure and operation mode of the existing Mekong River Commission according to the actual needs of the comprehensive dispatch.In particular,In this new watershed management mechanism,the River Basin Comprehensive Dispatch Service will be established as a technical implementation department.The agency can obtain the scheduling authority in accordance with the agreement,and directly issued the dispatch instructions to complete the objectives set by the comprehensive scheduling program.
