The Copyright Protection Of Chinese Sports Event Programs

As economy develops and daily living standards improve in recent years,people pay more and more attention to the pursuit of leisure time quality.Sports activities and sports events naturally become a popular object which numerous people are concerned with.It is the best time to broadcast,while Sports events are going on,which stimulates the emergence of a variety of broadcasts.Sina,Tencent and other network operators seize the opportunity to jump into the torrent of network broadcast.The number of subsequent disputes keeps increasing as well.As there are still many loopholes in the existing laws,when confronted by the copyright protection issues of sports events,the phenomenon that same kind of cases end with different judgments occurred repeatedly.Therefore,it is urgent to perfect the copyright protection framework of sports event programs,on the basis of the advanced experience in the relevant fields of the international community and the judicial practices of our country.The main body of this paper consists of four parts,namely "the overview of sports event programs","the comparison of the copyright protection of sports event programs among foreign countries","the research on the copyright protection of Chinese sports event programs",and "the suggestions for perfecting the Copyright Protection of Chinese Sports Event programs".The first part introduces the concept of sports event programs,through illustrating the phenomenon that same kind of cases end with different judgments.Then it distinguishes the concept of sports event programs from other related concepts to pave the way for the following specific research.The second part elaborates the relevant provisions of the common law countries and the civil law countries on the copyright protection of sports event programs,and combining them with Chinese copyright law system model,analyzes what lessons we can draw from these two legal systems.The third part defines the object identity of sports event programs,through summarizing the existing doctrines and cases,and sums up the contents of the right in the existing cases to find out the problems of the framework of the current law concerning the protection of sports event programs.In the fourth part,according to the above-mentioned problems,this paper puts forward the corresponding consummation ideas,which involves expanding the scope of the main body,clarifying the content of objects,strengthening rights protection.Hence these ideas could provide feasible suggestions for Chinese copyright law system of sports event programs.
