A Comparative Study Of Regulation Innovation Policies Of Governments Between China And South Korea

From the 1960 to the early 1980,Korea applied the strategy of government lead development which governments directly intervenes and this strategy caused the ultimately high speed development of its economy.And this justified the regulation of government.However,after the 1980,as the scale of economy and society rapidly increases and industrial structure advances,Korea needed regulatory reform for the purpose of enhancing national competitiveness.Responding to the needs,Korean government enacted the statutes of regulatory and organized organization exclusively for regulatory reform.Even though Korean government continues to prosecute strong regulatory reform,the evaluation of it differs.On the other hand,before Chinese economic reform on 1978,Chinese government implemented incredibly strong strategy of socialistically planned economy to substitute the role of the market.But,through applying Chinese economic reform,transition to the market economy,and joining to WTO on 1978 Chinese government consistently propelled regulatory reform and actually achieved a lot.But,China's legal system of regulation is yet incomplete and China does not have yet possessed independent and unifying regulatory organization.Based on these facts,the study overviews the theoretical background of government's regulation,and through in-depth consideration of Korean regulatory reform and Chinese regulatory reform this study conveys the right improvement of the future regulatory reform.In the introduction,it briefly displays the study's purpose,method and the context.In the first part,gives a general description of concept and necessity of regulatory reform,and of difference of social regulation and economic regulation in the point of theoretical consideration on government regulation.The second part conveys effect of regulatory reform by classifying the achievement of several different types of each Korean government.The third part overviews background,the present condition,content and evaluation per period and the instances of Chinese regulatory reform.At last in the fourth part,the conclusion provides the summary and the improvement direction.According to these contexts,the improvement direction of Korean and Chinese regulatory reform is as in the following:First,do away with the present regulation,minimize the government's regulation until it becomes a posteriori control.The transition of paradigm of regulatory reform is needed.Second,if diverse interested parties' conflicts are expected,then the participation of interested parties and the process of balancing act are required to produce the success examples and widen the range of implement by demonstration project.Third,in the early steps of enacting regulation,the system of analyzing the effect of regulation have to be improved and the sunset law shall be practiced.Forth,for the purpose of integrating the policy goal of regional and local economy,it shall designate local government or provincial government as a main agent of practicing regional regulatory reform.Fifth,exclusively organize independent organization of regulatory reform,and based on its lead,the construction of cooperative system of between each government agencies,between central and provincial government and between government and legislative branch is needed.
