Vehicle attaching management is the production in a special historical period of our country, which played an important positive role to some extent, the performance of a certain extent to facilitate people's life, and has greatly contributed to the economic development of China. But, over time, especially after entering the era of market economy, it has increasingly shows great disadvantages of such serious shortcomings and can not adapt to the social development situation of our country's economy. Facing such a situation, the state began to take restrictive attitude to vehicles affiliated business, therefore currently vehicle attaching management is only in our vehicles operating of taxi and cargo vehicles. Despite the existence of drawbacks, vehicle operating is still in a pivotal position. Of course, there are a large number of workers engaged in the industry, basing on the legitimate rights and interests of workers, how to better protect workers becomes imminent. In various parts of our country, their affiliated labor relations vehicle operations takes varied standard, thus leading to the emergence of the same in the trial practice sentences differently, to some extent, it undermined the authority of the judiciary. Therefore, this article studies how to identify a vehicle affiliated labor relations management, and focus on the facts of labor relations between the affiliated persons and affiliated units.In this paper, there are five aspects:First, introduces the development and review of operating characteristics of the vehicle attaching. It has played an important role in the history, but with the changing times, it has been gradually been restricted by China's policy and provisions, leading to the problems in identifying relationships.The second aspect focuses on the particularity in vehicle anchored relationship. Because the vehicle linked business is a unique form of management, there is a need for studying.Thirdly, by introducing the case, the passage focuses on the case of a person named Gao and a limited company and demonstrates the existence of labor relations between the two parts.Fourthly, the passage introduced affiliated labor relations. Recognizing standards are theoretically recognized standards and normative legal documents of that standard, labor relations anchored relationship is mainly the fact that labor relations identified, so how to identify the facts of labor relations is particularly important, and the facts of labor relations mainly introduced the theory called "subordination" doctrine.Fifth, the main vehicle introduced the problems in affiliated undertaking labor relations and the corresponding recommendations for improvements in the future. In terms of the main problem, the subjective judgment of this standard has inadequate attention,it does not do a very good combination of the two. And there is conflict of the understanding to subordination causing the problems in practice. These normative documents are also very vague, which runs counter to the clarity and law. Basing on the problems, I put forward several measures to improve standing on the position of real labor relationship.
