Research Of Effective Defense

As the Central Committee of CPC strengthen the efforts to fight corruption, a growing number of high officials are caught. In the consciousness of common people, they are able to hire layers to defend, but in fact the defenders they authorized are not hired by them. It is the Public Security Bureau, the Procuratorate, and the Court who assigned the lawyers to them. In June 2013, the defenders of Railroad tycoon Liu zhijun are Qian lieyang and Lou qiuqin who are well-known in the industry, but they are assigned by the Beijing Legal Aid Center. However, the court trial only last for 3 hours, and the outside questioned it’s just a show, and the defense are also part of the show. This phenomenon have drawn a heated discussion about the principle of Effective Defense among theorists and practice experts. The principle of Effective Defense requires to guarantee the suspected offender and defendant’s rights to defense. But how to define and measure effective defense has becoming the point of the lawyer, especially the Criminal defense lawyer. This thesis will be discussing the theoretical definition, legal function and the present situation of effective defense.
