A Probe Into Law Issues Of Logistics Regulation Of Dangerous Goods In China

In 2009,the State Council issued the "logistics industry restructuring and revitalization plan",which transferred the dangerous goods gradually into the modern logistics logistics.In the "Twelfth Five-Year" period,the rapid development of chemical industry led to the development of China’s logistics industry,especially the storage areas.For the risk of storage of dangerous goods,the state has invested a great deal of attention and made great progress in terms of legislation.But the storage of dangerous goods,after all,is an emerging industry,the current regulatory system still has many problems in our country,which need further perfections.By the research of related materials,many scholars have been studied from the perspective of enterprise storage of dangerous goods management,but few analyzed it from a supervision of the relevant administrative departments.By using legal knowledges,this thesis used analyzed the current status of the regulatory system in China for the storage of dangerous goods through literature research methods and case studies methods,and put forward appropriate recommendations to improve it.This thesis can be divided into three parts.PartⅠ:Introduction to the case.This part mainly Introduced the case that the Dongjiang Bonded Port dangerous goods warehouse explosion in August 12,2015 in Tianjin Ruihai International Logistics Limited Company(Ruihai company).I respectively described the case from the case after and the accident investigation results,and put forward the problems exposed in this case,it lead to the main problems of case studies.PartⅡ:Legal Issues Case reflected analysis.I respectively described the case from six aspects,such as the dangerous goods warehouse construction project approval,supervision of dangerous goods logistics and warehousing enterprises operating licenses,dangerous goods logistics and warehousing enterprises employed qualified supervision,the quality of storage conditions and packaging of dangerous goods regulation dangerous goods logistics daily supervision of warehousing companies,dangerous goods logistics and warehousing companies to develop legal regulatory issues contingency plans of the analysis.Finally,I work out the current logistics and warehousing of dangerous goods regulatory existing problems.PartⅢ:Completed the storage of dangerous goods regulatory system.This part contains three parts which are the completed logistics and warehousing for dangerous goods regulatory law,regulatory actions and establish a reporting system.I believe that we must strengthen our supervision of storage of dangerous goods in order to better regulate the activities related to storage of dangerous goods industry,protect people’s lives and property safety.
