Criminal Regulatory Framework On Transport Of Dangerous Goods By Air

The air transport of dangerous goods is very special both in the subjects of transport and pattern of transport. Therefore it has always been strictly managed and regulated by national legislation. However, in the process of air transport, accidents and crimes still increased with the rapid development of civil aviation. Both the international society and nations have formulated relevant laws and regulations to control and prevent the aforementioned crimes.Compared with international and foreign legislation, the criminal regulations in China are too dispersed to realize a strong penalty of crimes of air transport of dangerous goods. At the same time, they also failed to reflect and keep in line with relevant international conventions.Furthermore, the legal system is not compatible internally, too. Therefore, it is necessary to review through the domestic legislation, draw lessons from foreign legislation and target at the problems existing in the criminal law regarding air transport of dangerous goods. By strengthening the special criminal law, focusing on and integrating with the modernization of international convention and realizing the internal coordination of the legal system of China,we can perfect our domestic legislation, especially criminal regulation on air transport of dangerous goods.
