Dicuss On The Rescission Right Of Consumers

The consumer's right of rescission,as a system to protect the legitimate interests of consumers,was formed for a long time in foreign countries.It was first introduced into China in the Consumer Rights Protection Act which was enforced in March 15,2014,establishing the system of consumer's right to regret in China.In our country the consumer's right to regret is applicable to non face-to-face consumption such as online shopping,television shopping,and telephone shopping,etc.This paper mainly discusses about the consumer's right to regret in online shopping.Through the comparison of right of rescission in China and foreign countries and the analysis of problems concerning the practice of consumer's right to regret in China,this paper defines the application scope for the current system,provides the clear standards for good commodity,distinguishes the application deadline,and provides suggestions to establish punishment mechanism for abuse or malicious use of the right to regret.Based on that,this paper provides suggestions to relevant departments for the formulation of relevant laws and regulations.
