Study On The License System For Food Pruduction And Marketing In China

With the improvement of living standards, people are more and more concerned about the issue of food safety. The emergence of food safety problems not only reduces public's trust towards food safety, but impedes the economic development and affect the society stability as well. The license system for food production and marketing is an important form of pre-supervision of food safety; therefore, research on the license system for food production and marketing has important implications on both the protection of people's health and safety, and the promotion of economic development.Applying literature research method, inductive analysis, positive method, this paper mainly study the license system for food production or marketing from a perspective of law. By defining the concept of the license system for food production or marketing, this study proposed it's nature and characteristics, analyze it's theoretical basis, present the current situation of legislation and system. At last, it put forward the questions and reasons. The view of the paper is that we can take the following five measures to put an end to food safety problems and perfect the license system for food production or marketing. Firstly, perfect on-site verification system. Secondly, introducing the American system of administrative law judge in hearing system about selecting director. Thirdly, perfect the supervision to self-inspection of enterprise. Fourthly, complete the evaluation system of license system for food production or marketing. Fifth, complete the legal responsibility for administrative omission of the staff of Food and Drug Administration, and add related regulations of lighter or mitigated punishment or be exempted from punishment and other criminal responsibility.
