Study On The Civil Liability Issue Of Food Safety In China

With the rapid development of Chinese economy,people's living standard has been improved gradually.The most indispensable is food in people's lives.It has to be considered that food safety is resistant to the survival of the people.However,food safety issue arising from the diversification of food supply has become one of highly important issue in our lives.In recent years,there are thirty-four issues related to food safety laws and regulations in China,but China's food safety accidents still continue to occur.On October 1st,2015,the food safety law of the People's Republic of China,formally implemented,it emphasizes the most rigorous standards,the most stringent regulation,the most stringent punishment,the most serious accountability.New < Food Safety Law > stressed severe punishment as a deterrent and social governance principle of civil liability in the field of food safety accountability,compensation for the loss of the victim and effectively protect the civil rights of consumers etc.So this concrete research has theoretical significance and real meaning.However,the absence of civil liability is still an important issue in this law which is known as the history of the most stringent.In this paper,it mainly from thinking on current situation of food safety and the new <Food Safety Law>of the promulgation and implementation for the aspects caused by the current food safety system of civil liability in China.By using the research methods,mainly through empirical analysis,comparative analysis and civil liability analysis of domestic food safety situation and existing problems and try to put forward a proposal in terms of effective responsibility principle and compensation system,so as to better improve our food safety civil Responsibility system.Infringement hand in food safety incidents in the past repeatedly abandon governance means mainly short-term administrative penalties purify food market,so that victims get the maximum possible relief and compensation.By strengthening efforts to increase civil law norms to protect food safety,and ultimately build a long-term legal mechanism of governance of food security.
