China has 9.6 million square kilometres of land territory.China has both land and marine territory,also vast territory and abundant resources.Which enabled China to had became self-sufficient in natural resources in history.Since 17th century,China had implemented the policy which stoped all foreign contact,for as long as 2 centuries.Which made the development of China only focused on the land,while ignoring the development of the ocean.Since the Opium War,China has signed a series of unequal treaties,and ceded Hong Kong,Liaodong Peninsula,Taiwan,Penghu Islands and other territories.Which seriously undermine the integrity of China's sovereignty,and restricting the development of China's marine resources.China ratified the UNCLOS in May,1996.Affected by UNCLOS,China promulgated Law of the Territorial Waters and Contiguous Zone,Law of the Exclusive Economic Zone and the Continental Shelf,Island Protection Law,and some other laws and regulations concerning marine territory-based resources.Comparing to coastal developed countries,China's marine territory-based resources legislation in quantity and quality is still not complete.The task of legislation is hard to accomplish.While turning to Japan,which has frequent occurrence of maritime disputes in China,payed great attention to the laws and policies of the sea,and their legislation in the development of the ocean and the protection of resources has been very perfect.It is worthy of our attention and reference.We need to focus on Japan's maritime law and policy for two reasons.First,the current maritime disputes in the East China Sea command the attention of the world.Which includes the delimitation of the sea,the sovereignty of the islands,the competition for the oil and gas and the fishery resources,and so on.Learning Japanese law and policy of the sea is necessary for us both to judge the future of the disputes and to fight the right solution.Second,the mutual influence between China and Japan is a fact that cannot be changed.Japan's many positions on the ocean issues are closely related to the China's interests of the sea.Some of them have an impact on China's national defense security.Some of them concern how do we deal with the specific maritime affairs related to Japan.Some of them are useful references for the implementation of ocean management in our country.
