In the wake of the rapid growth of information technology,the era of big data has come The popularization of science and technology,information technology advances to improve people's lives,people are enjoying the convenience brought by technology,personal information security problems attendant,and is facing unprecedented challenges.Personal information is closely related to all aspects of people's lives,is the externalization of the exclusive characteristics of individuals,is the external form of personality rights,directly related to personal and property safety,etc..Now,big data have increased the risk of leakage of personal information,personal information infringement becomes more and more serious,the phenomenon of infringement is becoming more and more serious,the phenomenon of online selling and underground trading is very common,people often face the personal information is illegally collected,tampering,abuse and other risks,personal information has become the most important commodity.Therefore,how to solve the legal protection of personal information in the era of big data is particularly important.The era of big data is as a starting point for the legal protection of personal information for the demonstration center,this paper defines the right attribute of personal information,analysis and comparison of the relevant legislation on the protection of personal information from abroad,learn from experience,combined with China's current legislative difficulties and shortcomings,and puts forward some proposals to improve the protection of personal information in China.This paper is divided into five chapters:The first chapter elaborates the basic concepts and features of big data and personal information,distinguishes the personal information and related concepts,and introduces the challenges brought by big data to the protection of personal information.The second chapter is the definition of the right of personal information,the personal information of "ownership","privacy" and "personality right" and other theories were discussed and analyzed,clear the legal position of the personal information right.The third chapter is the comparative of the European Union,the United States and Japan on personal information protection legislation,and the legislative model are compared and analyzed,and briefly summarizes the countries to deal with big data produced by the proposed solutions.The fourth chapter mainly analyzes present situation of our country's protection of personal information,combing the existing direct and indirect protection of personal information protection laws and regulations,and for the protection of personal information under the era of big data problems are generalized.The fifth chapter puts forward some suggestions on perfecting the legal protection of personal information in China,from the legislative model and rules of foreign countries,put forward the legislative mode conforming to China's national conditions,and puts forward some concrete measures from many aspects to perfect protection of personal information in the era of big data.
