The Research On China's Foreign Service Trade Laws In The Context Of TiSA

With the development of service industry and the rise of service trade,some de-veloped countries formed the group which is called "Really Good Friends of Services,RGFS" to overcome the stalemate of Doha Round negotiations and promote the liber-alization of global service trade.Then RGFS launched the negotiations of Trade in Services Agreements(TiSA)in 2013.To make TiSA develop into a multilateral trade agreement as the ultimate goal of RGFS,TiSA was written on the basis of GATS text.TiSA has 23 negotiators now.China has applied to join the negotiation in 2013,which has not yet been accepted.The launch of TiSA has a positive effect on the further opening of global service trade.On an international scale,it will promote the liberalization of global service trade and provide the standard of the rules for China's regional trade cooperation,such as One Belt One Road,if TiSA is developed into a multilateral trade agreement.In domestic,TiSA can provide the guidance on the development of China's service trade law and the opportunity to make comprehensive survey on the issues of China's foreign service trade laws.Therefore we should analyze the issues of our foreign ser-vice trade laws which are badly in need of improvement according to the issues of TiSA to find the gap between our laws and the rules of international trade.But at the same time,the implementation of TiSA may has a negative influence on some countries.TiSA has further liberalizing rules in international service trade.If developing countries accept the rules of TiSA,it will strike the domestic service in-dustry.Under this circumstance,China should survey its level of development and its position in international service trade,in order to establish the basic strategy for the future response to TiSA and participating in international trade negotiations.With the tendency of further liberalizing trade cooperation,it is more urgent that we should perfect our foreign service trade laws.Legal system can protect the health and development of an industry.Regardless of whether China will eventually join the TiSA,the trend of international service trade to be further opening which TiSA represents makes requests to the improvement of our service industry and the laws of foreign service trade.So on the basis of our goal of development and funda-mental realities of the country,we should make laws and rules of foreign service trade timely which are in line with China's interests by learning the high-level open rules of TiSA.Although the government has been accelerating the revision of the foreign trade law,such as Foreign Investment Law(the Draft for Consultation)and the Cata-log of Industries for Foreign Investment(the Draft of 2016),and accumulating expe-rience in the free trade area in our country,there is still a certain gap between China and developed countries which need to be narrowed.Therefore the author hopes to provide countermeasures and suggestions to modify and improve our foreign trade laws in terms of market access,domestic regulations,state-owned barriers and the protection of personal data,etc.,with the guiding significance of TiSA,which aims to make the domestic legal system of services trade in line with international standards.
