On The Comparison Between The Admission Policy China And Laos' Investment Law

With the trend of economic globalization and regional economic integration,the role of foreign investment,which occupying an important position in the international economic and trade exchanges,has become increasingly prominent.Among the factors influencing foreign investment,the investment legal system of the host country is one of the most deceives parts.By comparing the investment law systems of China and Laos,especially the similarities and differences of the Admission Policy,it is helpful to provide strategic consideration and theoretical reference for Chinese enterprises to invest in ASEAN.On the other hand,it can also give some hints on improving the investment admission system of the two countries.In 2009 Laos issued the latest Investment Law to unify domestic investment law and foreign investment law.In 2015,the Ministry of Commerce of China issued the Draft of Foreign Investment Law to consolidate the "Three Investment Law" into a consistent legal normative system.In Admission system,China and Laos are in accordance with international practice of the Former National Treatment principles and Negative List management model:the Negative List provides prohibited,restricted,permitted and encouraged investment areas,industries and investment areas.In the application process,China and Laos have also set facilities for foreign investment in admissibility,approval and management institutions.In addition,in order to ensure the safety of investment,China has also joined the safety approval process.The Admission system is the regulation and control by the government on the entry of foreign capital into the national economy.Its aim is to guarantee the economic security of the country,regulate and manage the economic situations and thus create a stable,healthy,and growing economic state.Therefore,on the basis of comparing the two countries' Investment Admission system,the paper analyzes the advantages and disadvantages of the Admission system and tries to make suggestions for the future investment enterprises to get familiar with the related Admission system,industry policy and precaution etc.,and to provide the necessary theoretical reference.
