An Empirical Study On The Convergence Between The Food Administration Law Enforcement And The Criminal Justice In Ordos

"As for the people,food and security come first".However,a series of radical food safety incidents have taken place in recent years,such as the substandard milk powder and the clenbuterol etc.The serious situation has aroused greater reflection on the existing predicaments and solutions of the food safety problems.Based on the theories of the administrative law enforcement and the criminal justice,this paper takes Ordos as an example to study the status of the convergence between the food administration law enforcement and the criminal justice by using the methods of the documentary analysis,the empirical research and the system analysis.On this basis,the paper analyzes the problems and causes of the convergence of the food administrative law enforcement and the criminal justice in Ordos,and proposes some improvement measures accordingly.It is observed that there are a few problems of the convergence between the food administration law enforcement and the criminal justice in Ordos.Such as the difficulty of investigation and evidence collection,the low proportion of submitting cases and the legislation dispersion and low effectiveness.Besides,the main reasons of the above problems are unclear standards of submitting cases,unified rules of evidence and requirement,insufficient supervision of procuratorial organs,and insufficient function of information sharing platform of the convergence between the food administration law enforcement and criminal justice.In view of the above problems,I suggest that the following measures should be taken into consideration on the improvement of the convergence mechanism between the administration law enforcement and criminal justice in Ordos:establishing and improving the working system of food safety cases,improving relative laws and regulations of food in term of legislation,strengthening the superintendence of procuratorates,ameliorating the establishment of the information sharing platform of the convergence between the food administration law enforcement and criminal justice.
