Research On Legal Problems Of Toll Of Expressway In The Perspective Fo Administrative Law

Highway tolls policy is to raise funds for highway career development,and to serve the economic development of China.Since the opening of the first toll highway in 1988,our toll highway has developed nearly 30 years.During this period,our highway develop from nothing and gradually developed to now,the mileage of highway has became the first position in the world.It played a vital role for our country's nearly 30 years of sustained and rapid economic development.Our highway management and charging systems are also gradually legalized.However,the controversy for the legal attribute of highway tolls,legitimacy,and charge money flows has never interrupt.Many legal issues still exist in the operation of the expressway toll collection,what restricted the sustainable development of highway construction enterprise in our country.Hence,this article in the perspective of administrative law,using the theory of administrative authority and administrative fees to study highway tolls,I think that patterns of the expressway toll collection is conform to the requirements of the administrative law in our country and the developing mode of social needs,the problems of current highway charging are because the lack of administrative legislation,the improper intervention of administrative authority and the vacancy of administrative supervision.In order to make the expressway toll collection more standardization and legalization,promote rule of law,this paper puts forward some recommendations on administrative law and regulations.Specifically,this paper is divided into four parts:firstly,the development of our highway and research status.Next compare the characteristics of administrative law,advantages and disadvantages.Combined with the empirical research of the expressway toll collection in China,find out problems which restrict the development of the highway in our country.Finally combining the study of foreign excellent management methods and the existing problems,from the perspective of administrative law to determine the nature of our highway,and put some appropriate reform suggestions to our highway tolls.
