On Problems Existing In Administrative Charge And Countermeasures Against Them

The system of administrative charge has been long standing. Now the charge has a multitude of names and its standard is too high, because many regions and units violated state regulations, increasing the items and raising the standard of fees arbitrarily. Seeing that collecting fees at random was becoming more serious day by day, the state emphasized it must be put in good order repeatedly and laied down a series of regulations and decisions to settle it, but the problem hasn't effected a radical cure all along.So many problems arising in administrative charge were out of varied complicated reasons, among which there were structural problems, legal system problems, human factors and objective causes. Administrative charge is such a knotty problem that it has always puzzled us. Without solving it appropriately, not only the masses' work and life, but also the social stability and state's sound and continued growth will be influenced.The enactment of Administrative Charge Law of The People's Republic of China has been placed on the legislative program by the Tenth National People's Congress after the Administrative Permission Law of The People's Republic of China made and promulgated in 2003. This symbolizes that the administrative legislation of our country will welcome in great developments. At the very moment, it is very necessary to analyse the causes of administrative charge, to inquire into some important problems on administrative legislation and discuss a comprehensive plan for solving the problem of collecting fees at random. From the basic theory of administrative charge, existing problems and harm, causes of problems and solution, etc four parts, this thesis is mainly to make a discussion about administrative charge.
