The Research On China's Management System Of Wild Animals Import & Export

China,as a big country in international trade of wild animals trade with a long history,is an important contracting party to Convention on International Trade in Trade in Endangered Species of Wild Fauna and Flora(CITES).It has become increasingly important for China to make its management system of wild animals import & export more scientific and efficient,because such management is an important composing part of wild animals management and plays positive roles in effectively protecting and sustainably utilizing wild animals resources,as well as promoting socio-economic development as a whole.China's management system of wild animals import & export is focused on as the main contents in this thesis,with emphasis laid on the systematic analysis and assessment of relevant laws & regulations,management organization,operation mechanism,and administrative measures.Then some development ideas and concepts are studied for effective management of international trade of wild animals,for promoting reservation and sustainable utilization of wild animals resources,and for improving China's management system of wild animals import & export(WAIE),with some proposals and advices put forward for further deepening the reforms of such management system.In Chapter 1,introductions are made about China's laws & regulations on wild animals import & export(WAIE)management,as well as CITES.Regulations of PRC on Administration of Import and Export of Endangered Wild Animals and Plants is analyzed in emphasis,and trade management modes as included in CITES are categorized.Then summarization is made for CITES's revelations on China's WAIE management legislations.In Chapter 2,introductions are made to China's WAIE administrative organizations and their functions,and the operation mechanism of WAIE administration in China is explained from the aspects of WAIE approval procedures,marking,quotas administrative measures,relevant units register,and the administration of enterprises by different levels.Chapter 3 is an analysis on the achievement,problems and reasons of China's WAIE management.The author of the thesis summarized the main problems and shortcomings of China's WAIE management as follows: lack of categorized management mechanisms and matching measures for import & export management;complicated and complex procedures for WAIE administrative approval,with the problem of “too much stresses on approval,but not enough supervision & management”;lack of legal basis for supervision of some species' WAIE,with WAIE management to be urgently promoted with scientific decisions;and the measures of supervision at ports to be perfected urgently.In Chapter 4,reform advices are put forward with targets on existent problems of China's WAIE management,with the main principles to adhere to while reforming such WAIE management system as follows: The first principle,be conducive to wild animals resources when handling the relation of their protection and utilization;The second principle,stick to “being less strict with import but more with export” when handling the import-export relation;The third principle,treat the two links of APPROVAL and SUPERVISION & EXAMINATION in WAIE management with correct manner,with adherence to service attributes for approval and administrative attributes for supervision & examination.The concrete advices include: to perfect the WAIE management legislation;to enhance functional building of related institutions for more regularized and more scientific management;and to give full play to the inter-department coordination mechanism for convention obligations fulfillment,with the establishment and perfection of matching management measures.
