The Legal Problems Analysis About Public Authorities For Salvage Reward

In recent years,with the continuous development of shipping industry,there are more and more maritime threats of traffic safety and sea accidents with marine environment pollution.For protection of channel security like,coastal countries,public interest,related international conventions and domestic legislation are authorized countries to take compulsory measures to invent salvage at sea.In this background,the public authorities take apart in maritime salvage accidents more frequently.In the salvage,because of public authorities as the principal part of rescue,the case filing salvage reward claim by public authorities are also increasing in recent years.In this paper,we discuss public authorities for salvage reward of legal problems with four chapters.The first chapter focuses on the present situation of the public authorities to participate in salvage around world,from the whole environment to explore whether public authorities have the right for asking price.The second chapter centers on the public authorities salvage legal behaviors,to define public authorities,discussing the legal attribute of public authorities salvage behaviors and discussing the necessary of the public authorities salvage.The paper will try to find the differences between public authorities rescue behaviors and commercial rescue behaviors.The third chapter mainly discusses the realization of the public authorities for salvage reward by public authorities realize the salvage reward claim legal barrier and the basic principles of public authorities for salvage reward and point out that China's public authorities for salvage reward and the existing problems.Combined with the full view and conclusion,in the forth chapter we will take advice include building our country's authorities for salvage reward system.
