Human Rights Protection Under The Perspective Of International Law Regulation Of The Arms Trade

Existing on the current international arms trade rules cannot effectively regulate arms trade behavior,legal arms trade activities can not get the guarantee,also can not get effective punishment of illegal arms trade behavior.Arms trade as a special form,its existence has closer relationship with human rights.However,the current status of the existing,can not the fundamental human rights in the field of international trade.There is no denying that is causing this situation,do not rule out because of limitations of arms trade rules,but more is due to the protection of human rights is not enough attention,also should have no part in their own ability within the scope of their responsibilities.And,according to the present situation of the international community,can be used to regulate international legal mechanism of arms trade is very limited.But,with the arms trade rising year by year,of the total amount of scholars from all over the world has preliminarily realized the norms of the international arms trade legal mechanism on human rights and humanitarian law also has the important role.Comprehensive regulation international arms trade,therefore,must fully consider the human rights and humanitarian law,will the existing international law related principle as the foundation,the human rights responsibility concrete embodiment and implement in the field of international arms trade.Although,the regulation of the international community in the arms trade issues made a lot of effort.but there are still many problems.Weapon system has not been formed in the field of trade,for example,the international and domestic legal regulation system,lack of better execution and supervision mechanism,and so on.Based on the study of the arms trade treaty,for example,to analyze the existing international arms trade treaty,the implementation of the present situation and existing problems,to improve the international legal regulation system as the main way to achieve the ultimate goal of the protection of human rights.The research emphasis of this article is the protection of human rights as the basic starting point,on the basis of the analysis of the existing legal norms,further to protect human rights perspective to look at how to more effectively regulate the international arms trade.
