A Study On The Statutory Licensing Of Copyright In Cyberspace

With the popularity of network broadband,digital equipment and wireless networks,Internet is already beyond the traditional media and becoming an important carrier of the work. At the same time, the development of the Internet can promote the transmission of the work, it also makes the traditional author's right system be a strong impact. Under the network environment, the digitalization of the work form has changed the traditional mode of creation,dissemination, application. This also led to the current copyright protection and limitation of system not adapted to the development of the Internet. Statutory license as an important copyright restriction system, it has shortcomings in legislation and judicial practice, as well as rapid internet development trend, the existing statutory licensing system can not meet the needs of social development.As a result, this article based on the basic theory of copyright statutory license and the current situation of copyright under the network environment, through comparative analysis, empirical analysis, historical analysis, combining the legislative experience and practice at home and abroad, Analyzing specific problems about applicability of statutory licensing system in the current network environment. We can draw a conclusion that under the network environment, the legal permission system of copyright in our country has not been reproduced in the network, distance education, digital library, poverty and so on. Stautory license in cyberspace must be clear about its legislative value. The scope of the stautory license should be adjusted. The guarantee system of statutory licensing system needs further improvement.
