Research Of Liang-Qichao's Constitution Theory

Mr.Liang is a non-ignorable leader in the development of constitution thought in the 20th,as well as a sign of the constitutionalists' theory.His constitutional monarchy is a key link in the theoretical and practical development of Chinese Politics.Although history didn't choose Liang's political view,lots of concepts or conception makes a start of and makes reference to the constitutional theory in China.Liang represents the gentry class of the late Qing Dynasty.He received traditional Confucian education,and has a strong emotional link with Confucian culture.His thought stemmed from Confucianism,and Confucianism means not only knowledge but also faith for him.In order to make China get rid of the internal and external problems,Liang had always been trying to develop Confucian culture,supply the gap between Confucian political theory and new political theory from the West,and establish a kind of modern political theory under the restriction of constitution.Research on Liang's constitutional thought can not only help us get knowledge of the development of constitution thought in the 20th,but also help provide reference for the exploration about the value of Confucian culture on the way of construction of constitutional government in China.The author attempts to summarize and analyze Liang's constitutional thought,after reading Liang's writings about constitutional theory and researches on Liang's constitutional theory.First,the dissertation attempts to summarize the development of Liang's constitution theory,and get straight the standpoint and features of Liang's constitutional theory.Secondly,in order to get knowledge of the frame and bases of Liang's constitutional theory,the dissertation analyzes Liang's thought of nation and people's rights,and analyzes Liang's opinion about the condition of constitutionalism in China and his design of constitutional system for China,and analyze thoes form and content after separate out relevant content from Liang's writings.Thirdly,the dissertation also attempts to find how the Confucianism and the theories from the west influence the establishment and content of Liang's constitution theory,in order to deeply analyze the theoretical source and essential attributes of Liang's constitutional theory.On the influence of Confucian,the dissertation will start with Liang's education experience,analyze Liang's knowledge about Confucian,and find the reflection of the Confucian in Liang's constitutional thought.The influence of the thoughts from the west includes the influence of those theories and practice.The influence of theories can essentially be generalized into the import of natural rights and utilitarianism,and the national,right,constitutional theories based on those.The study and analysis of the practice of constitutionalism helps Liang estimate the effect of those constitutional systems in China.In the end,the dissertation attempts to find the referential value of Liang's constitutional theory,and tell the possible cultural and institutional function of the Confucianism for China's constitutionalism in the future.
