A Study On Taiwan Lawyers' Examination

With the development of social economy,the exchanges between people more and more frequently,followed by the emergence of more and more legal disputes,this time highlights the lawyer of this career in the importance of daily life of citizens.Not only the judge,the prosecutor is responsible for the protection of the legitimate rights and interests of citizens,lawyers also have the same aim and purpose,therefore,lawyers as legal professionals,also shoulder the important responsibility oflaw society.In order to achieve the rule of law,lawyers must form a strong community which is embodied in the knowledge structure,the way of thinking,the concept of value and other aspects of consistency.Lawyer career is a professional and technical professional,to become a qualified or even a good lawyer,it is necessary to have a variety of qualities,these qualities can be summarized as the quality of knowledge and skills.And the lawyer examination is to meet the needs of modern rule of law with the quality of knowledge and skills of the talents selected to the professional ranks of the lawyers.Examination as a selection of the qualification examination,it certificate the qualified candidates have the professional knowledge and professional competence and other necessary conditions.Therefore,the lawyer examination is an important part of the selection of outstanding lawyers,the key point of the profession access system,reflecting the seriousness of the law and the importance of the rule of law.Lawyers' exams help to improve the professional quality of legal practitioners,ensure that high-quality legal personnel enter the ranks of lawyers,and are conducive to the realization of lawyers' professional community.Lawyers only have common legal beliefs,rich legal professional knowledge and necessary legal profession quality,in order to effectively safeguard the authority and unity of the rule of law.This paper first gives a brief introduction to the situation of Taiwan lawyers' examination,including the composition of test questions,the quality of examinations and the purpose of examination.Secondly,it takes the Taiwan lawyers' examination questions as the research object,and analyzes the characteristics of Taiwan lawyers' examination questions in test papers.Combined with the modern society and people demand for lawyers,it point out that the Taiwan lawyers test questions in the examination content,test questions,test range and other aspects.Taiwan lawyer exam questions have not been designed from the perspective of the lawyer's point of view,the candidates can not make a comprehensive examination of the legal professional quality,it can not choose a professional,self-discipline,public welfare,in the ground,the international characteristics of outstanding lawyers.Therefore,the Taiwan bar exam questions need further reform.The reform should grasp the right direction.In this paper,from the point of view of the professionalization of law profession,the thought of elite and the target of lawyer examination,and draw lessons from other countries or regions,Taiwan bar exam questions should deepen their understanding of the legal ethics and law English,set on diverse questions of depth examination,interview candidates to test the professional thinking,put the practice into the lawyer exam.This reform can be selected with a wealth of legal expertise,higher legal professional skills,good legal literacy and strong sense of legal justice lawyers,to ensure high-quality lawyers.
