In Chinese traditional ideology and culture,marriage is of great significance.Since the reform and opening up,people's living standards continue to improve,the pursuit of material and spiritual become more and more rich.Under the impact of Western culture,people are increasingly advocating love freedom of marriage,the Chinese attitude towards marriage changes gradually,while the pace of life to speed up the work pressure,income gap,child support and other factors to bring a certain marriage Influence,so the issue of divorce draw more and more attention by the community.In 2014,China's divorce was 3.637 million pairs,an increase of 3.9%over the previous year,and there are 2.957 million pairs of registered divorce,679000 pairs of judicial divorce,judicial divorce is about 18.7%,divorce disputes become increasingly prominent,and property distribution is the focus of divorce disputes.Husband and wife property system is the main content of marriage and family law,but also constitute a part of the entire social property system.In the case of the trial,the problem is mainly focused on the issue of husband and wife property and the raising of children,there is no more controversial on whether the couple is not harmonious,or whether to restore the marriage.The issue of property division is controversial,and how the distribution of property when divorce is the topic of concern to the parties.With the development of China's socialist market economy and the reform of the housing system,the common property structure of the couple has diversified.The common property of the husband and wife in addition to the past simple housing,deposits,vehicles and other property,to expand the production and operation income,stock,corporate equity,provident fund,claims and other intangible property,especially housing and equity and other large value of property in the common property occupy a large proportion.According to the provisions of the Marriage Law of China on the principle of the distribution of property,priority of agreement and equal distribution,appropriate care of women and children.In the actual judgment,what factors affect the judge's decision,whether the verdict is consistent with the law,whether the protection of women reflects the value of the law,is the content of this article to be studied.In order to combine macro-law and micro divorce property judgment,we use economic view to study the protection of women's rights and interests.The divorce property judgments will be integrated in the verdict to extract effective information,the information assigned to the factor analysis and empirical research,through data analysis to reflect the extent to how our law protects women's rights.This paper not only discusses from the theory,combined with the empirical analysis,so that the study is more persuasive.The main text is divided into four parts.The first part is to sort out the current situation of the marriage law in China,and analyze the influence of the principle of divorce property distribution on the verdict.In the second part,the statistical analysis of the collected samples is carried out,and the economic analysis is used to analyze the reasons for the protection of women in the distribution of property.The hypothesis is put forward according to the statistical results and theoretical analysis.The third part uses STATA to analyze the collected samples,through analysis of variance,factor analysis and linear regression analysis,extracted and analyzed the factors that influence the judgment of divorce property dispute.The fourth part of the empirical analysis of the results described,found that the current distribution of divorce in the protection of women's rights and interests are not optimistic.Through the empirical analysis of the results and make legal recommendations on the improvement of the law in order to attract more attention to the protection of women's rights and interests.
