In the current arrangement of judicial system reform,the reform of the clerk profession still not attracted enough attention,the clerk's procedural value and status has not play its due value in law court.The reason is clerk system have more serious flaws,it is value is not used.The author try to construct a new system by the way of improving the clerk system——The Secretary system,aim to replaced the clerk.This paper is divided into four parts,except the introduction and epilogue:The first part of this paper analyzes the meaning and necessity and feasibility of the secretary system.This section include ascertain the secretary system is a new system,and his purpose is to make sure the secretary's value utilization.The meanings of secretary including:definition of secretary;his duty;the difference between clerk and secretary.The author tells us why build this new system:first,for better development about the judicial system.Then,think of secretary as a member of the judge team,aim to form a force of restriction and supervision,keep the fair.Last,analyze the value of the secretary system from three aspects.The second part mainly through two backgrounds to explain the situation what the new system will meet,the two backgrounds mainly refers to the clerk system's defects and illegal resolution of court record.The defect of the clerk system's and record is the primary coverage,in another word,the defect of the clerk system demonstrates the urgency of system construction.The third part of this paper,mainly tell us the secretary's management abroad,reference to France?Japan?England and American.The institution in these four countries runs well,the secretary's selection and appointment?occupation and security system all is the main reference.The fourth section is the center content of the article,present the specific content about secretary system,this section also includes four parts.First,the writer definite the character about secretary;Then present the management system,include uniform the appointment standard,suggest joint with school to guarantee recruitment sources.Next is the construction about the secretary's appraisal system and security system.finally is the legalization of record,the point to make here is that the secretary must be the only legal subject,meanwhile the new work standards should be issued under the secretary system,provide the court record with reference standards.
