Research On The Mobile New Media Copyright Protection

At present,the development of mobile internet in China is already gradually mature.According to China Internet Network Information Center,at the present stage China's mobile Internet users growth is far more than the overall growth,and the duration of using mobile devices is more than doubled of PC.On one hand,the prosperity of mobile internet brings rapid development of mobile new media,giving birth to WeChat,Sina Weibo,Zhihu and other advanced mobile new media platform provider.For another,the traditional copyright law has experienced a great impact In the mobile new media environment,the protection of copyright of mobile new media works is lagged obviously.So the protection of mobile new media copyright in our country has become a hot problem from industry and academia to discuss.Based on the analysis of domestic and foreign research status about the thesis and dissertation on the basis of the research purpose and its meaning,this article expounds the concept of mobile new media copyright and features and describes the main contents of mobile new media,that the right to network dissemination of information,the right of reproduction,as well as restrictions from the media copyright,and by analyzing the problems existing in the mobile new media copyright protection in China,learn the advanced experience from Anglo-American law countries and of the civil law countries,provide the related suggestions to mobile new media copyright protection in China: In respect of legislation,explore more flexible legislative mode of fair use system,enlarge legal permission application range,set out rational and effective system of temporary reproduction.In respect of judicature,perfect the regulation for proof citation,improve the part of electronic evidence collection and preservation,stipulate the compensation standard of infringements clearly.In respect of the system and supporting measure,build the extensive copyright collective administration,introduce competing system and improve the legal consciousness of relevant subjects of copyright protection,for making better communication of works in mobile new media environment.
