The Research On Duration Of Marine Cargo Insurance

This paper focuses on the research on duration of marine cargo insurance.PICC Ocean Marine Cargo Insurance Clause referenced Institute Cargo Clause,but the latter has changed a lot.In practice,there are many disputes in the application of PICC ocean marine cargo clauses.Comparing both can consummate Ocean Marine Cargo Insurance Clause.This article is divided into six parts to write.The introduction points out that the mainly marine cargo insurance clause are Ocean Marine Cargo Insurance Clause and Institute Cargo Clause,but the regulation of the duration is different.Then studying a case shows that the application of different clauses has different effects on the duration,so as to make a detailed analysis of these two clauses.In the first chapter,this paper gives an overview of duration on marine cargo insurance.Firstly introducing the background of the duration on marine cargo insurance,then introducing the duration of marine cargo insurance in international trade,analyzing the transfer of ownership and insurable interest.The insurable interest will be restricted by international trade terms,thus in the actual using different terms will have different duration.The second chapter is the analysis and research on the beginning of duration on marine cargo insurance.Firstly introducing the relevant provisions of PICC Ocean Marine Cargo Insurance Clause and Institute Cargo Clause,then points out that in practice there is disputation on "far from the origin warehouse" and the difference among establishment,effect and beginning of duration.Finally,these problems are considered.To clear the insurance liability from the point of time,shipper's warehouse,then the paper discusses the influence among the establishment of insurance contract,backdating policy guarantee and the beginning of the duration on marine cargo insurance.The third chapter is the analysis and research on the continuation of duration on marine cargo insurance.Firstly introducing the relevant provisions of PICC Ocean Marine Cargo Insurance Clause and Institute Cargo Clause,then pointing out whether there is a link between the transportation route and the transportation purpose in the practice and long time storage of cargo terminals whether terminates the continuation of duration on marine cargo insurance · Finally,these problems are considered.This paper deals with the relationship among the collateral purpose test,the term of delay and the continuation of duration on marine cargo insurance.The forth chapter is the analysis and research on the termination of duration on marine cargo insurance.Firstly introducing the relevant provisions of PICC Ocean Marine Cargo Insurance Clause and Institute Cargo Clause,the termination of duration on marine cargo insurance shall be divided into the termination of duration on marine cargo insurance under normal transportation and the abnormal transportation.Then it is pointed out that the existence of the consignee's warehouse is different in practice,the subject-matter insured is weather actual allocation or distribution and the Assured don't know the ship sails for another destination.Finally,these problems under normal transportation and the abnormal transportation are considered.The fifth chapter from the beginning,continuation and the termination of duration on marine cargo insurance,analyzes the problems found in the second chapter to the forth chapter and gives advise.
