A Study On The Legalization Of Organizational Environmental Responsibility In International Project Financing

With the rapid development of economic globalization,the financing of projects between countries and organizations has become more and more frequent,and the environmental problems caused by them have become more and more serious.This has made the issue of environmental responsibility in international project financing increasingly become the focus of governments,investors,local communities and international organizations.And ISO26000 officially released in 2010 that expanded the subject from the economic organizations to all kinds of organizations is a good solution to the subject of environmental responsibility,which means that the concept of environmental sustainable development has become increasingly deeply rooted in everybody's mind today,all kinds of organizations are responsible for our environment,and any attempt to bypass the environmental responsibility of economic activities can only be a paper empty talk,so the international project financing of the two sides of the participants responsible for our environment naturally obligatory.As the largest developing country,China is in a high-spirited attitude to actively integrate into the tide of economic globalization,and it accepts financing or invest aboard increasingly frequent,but numerous environmental costs followed.In view of this,the relevant departments of our country should consider the legalization of the organizational environmental responsibility in China's international project financing,which can refer to the relevant provisions of the International Finance Corporation ' s(IFC)"Social and Environmental Sustainability Performance Standards" and the development of relevant legal norms in light of specific circumstances and modify it in a timely manner,with a view to the economic development in the future to reduce the occurrence of such disputes or to avoid passiveness in such disputes.By taking the complaint regarding IFC's investment in subsidiary of Bilt Paper B.V.as an Instance,this paper analyzes the environmental disputes of IFC's project financing through three steps:the first step is to introduce the case,including the introduction of the basic case,clarify the views of the parties and summarize the conclusion of CAO;the second step is to sum up and analyze the controversies in this case,including the summary of the controversies in this case,the legal analysis of environmental responsibility of organizations and the analysis of the controversies in this case;the third step is to make recommendations on the legalization of environmental responsibility,including the legalization of environmental responsibility when China accepts foreign investment and the legalization of environmental responsibility in China's external financing,which expect to provide some references for the reduction or resolution of environmental disputes of project financing and loan in China.
