With the deepening of economic globalization and the development of Internet technology,cross-border e-commerce has become a hot-spot topic in the global society.It is necessary to adjust this new type of trade model with rules given its features of non-nationality.However,the trade model which is a combination of multiple factors with "business + technology + globalization" has brought new challenges to the existing legal system,and arouses the wide concerns of the international community and many sovereign countries.In the context of the implementation of the "Internet +",strategy in China,it is particularly important to improve the legal system of cross-border e-commerce,and the "E-commerce Law(draft)" has set up a cross-border e-commerce chapter which focuses on personal information Protection,tariff system and dispute settlement mechanism.This thesis analyzes the dilemma faced by China's cross-border e-commerce legal system from these three levels,and makes horizontal and vertical comparison of the rules and legislation of cross-border e-commerce in the international community.In the protection of personal information,it is important to appropriately balance the protection of personal information while avoiding excessive protection of information caused by trade barriers appropriately.For the tariff system,setting a reasonable level of digital products in the e-business field.And for the dispute resolution,based on the characteristics of cross-border e-commerce should build a more effective online dispute resolution mechanism.In this way,the establishment of international e-commerce clauses as well as the development of China' s cross-border e-commerce can be promoted.
