Comparative Study On The Exit And Entry Administration Laws Concerning Both Sides Of The Taiwan Strait

The immigration management system is a kind of legal system which is widely practiced in various countries around the world.The entry and exit administration of Taiwan is an important part of our country's immigration management system.After years of developing cross-strait relations,the interaction between the two sides at various levels tends to be more frequent.On the one hand,the forms,channels and levels of cross-strait exchanges have been continuously promoted and expanded.On the other hand,the new trend of cross-strait exchanges between the two sides has produced many conflicts with the law.Cross-Taiwan-strait personnel exchanges are not the same as those between mainland China and Hong Kong or Macao,neither as migrate to other countries.At present,the immigration management departments of the two side authorities take "Double Certificate,Double Audit" working model to manage the flow of personnel across the Taiwan Strait.Therefore,there is an imbalance between the two sides in safeguarding the peoples' immigration rights and other interests as well.The author relates the current situation and problems of the residents of mainland China entering and exiting Taiwan based on researching the Measures for the Administration of Taiwanese Citizens,and then analyzes the Regulations on Relations between the Taiwan and Mainland China,points out the status and problems of Taiwan residents entering and exiting the mainland.Through comparing the cross-strait immigration management legislations and the cross-strait immigration management system,the author puts forward in the framework of "One Country,Two Systems" to improve cross-strait relations,and should pay more attention to cross-border immigration management interaction,cross-border immigration management legislation in order to improve cross-border judicial assistance and other proposals to deal with the new problems.The innovation points in this thesis includes:1.the research on the entry and exit of the Taiwan Strait is relatively new,and very few domestic scholars have involved in this area.2.Using the opportunity to study in Taiwan University,the author investigates the cases of the mainland spouse having applied for the reunion interview and the mainland students to Taiwan.3.Using the comparative research methods,the Mainland China and Taiwan cross-strait immigration management laws to improve the relations of both sides.
