Study On Community Correcion Procuratorial Supervision

As a kind of non-imprisonment punishment,community correction is helpful to promote the criminals to accept the education reform,return to society smoothly,and save the lawsuit resources,it is highly praised by more and more experts and scholars.Our country has also introduced the system on the basis of the pilot practice and has been widely spread in the whole country.However,with the deepening of the reform of the judicial system and the wide application of the community correction system in our country,this kind of penalty alternative enforcement measures have exposed many problems and imperfections in the judicial practice.As a legal supervision organ,the procuratorate should play a role in the community correction,which is to supervise the implementation of community correction and community correction.But there are also some problems in the field of community correction procuratorial supervision,which affect the development of its functions.The author of this dissertation is based on the background of the judicial system reform and the practice of community correction procuratorial supervision,and the work of the community correction procuratorial supervision in the city of Guangxi Zhuang Autonomous Region under the reform of the judicial system is taken as the sample.Through access to the latest development of community corrections and procuratorial work related to the system,to collect community corrections prosecution business-related statistical data,in-depth community correction to visit the city of the city(city,district)Procuratorate Procuratorate,sent to the detention center,Prosecutors room,part of the township judicial office community correction agencies to conduct research to understand the actual situation of community correction procuratorial supervision,under the whole data analysis and relevance thinking,the use of community correction and procuratorial supervision theory analysis of community correction supervision in the existing problems and the deep-seated reasons,and then targeted to propose relevant measures.The whole dissertation consists of four parts:The first part discusses the basic theory of community correction from the concept,constitution,characteristics and theoretical basis of community correction procuratorial supervision.The second part of the community correction in laibin,procuratorial organs procuratorial supervision work to inspect samples,laibin,procuratorial organs are summarized in detail of procuratorial supervision institutions of community correction,policemen,supervision and correction of community correction illegal behavior in recent years.The third part through the analysis of survey data and information,points out the current problems existing in the procuratorial supervision of community correction work,mainly include:the procuratorial supervision strength is weak,the investigation of community correction evaluation supervision,personnel of community correction problems during the implementation of the delivery,there is lack of personnel management system of community correction.The fourth part on the basis of analyzing the question of fact put forward related Suggestions to perfect the procuratorial supervision of community correction,which increases the judicial system reform under the new situation of procuratorial supervision power,legislation explicitly the procuratorial supervision in the process of community correction function of procuratorial organs,procuratorial organs to participate in community correction legal supervision survey assessment,strengthen the communication between the community correction delivery to perform related departments coordination,strengthen community correction oversight activities of the procuratorial supervision,as well as the rational allocation of procuratorial organ in the remit of community correction,etc.
