On Mode Perfection Of The Constitution Enforcement

The constitution,which is the fundamental law of the highest legal effect,stipulates the country' s basic system,citizens'basic rights and obligations,and the duties of national institutions."Pure kindness can not govern the country,and law alone can not be enforced by itself”,which shows that law should be implemented.The constitution is no exception.Not being put into effect,a good constitution will finally be nothing and the will and interests contained in it can' t be realized.Though a well-made constitution is the basic to pratice constitutional power,constitutionalism is not the final purpose.Based on it,It is crucial to conduct constitution,build up the citizens' belief in constitution,and protect the basic rights of citizens.There are many factors causing the constitution not fully implemented,such as the deficiency of constitution,the imperfection of the constitutional supervision mechanism,constitution's not entering the judicial realm,and the loss of belief in consititution,which has a great influence on its founction.The effective implementation of the constitution can ensure the constitution to play a role maximizedly and to establish an authority image for both citizens and social organizations.The first part of this thesis aims to discuss the policy and reality background,and summarize the research of constitution conducting as well as the mode of constitution conducting at home and abroad.The sencond part is about the significance of the mode to implement the constitution,and the concept of constitution implementation as well as the mode to conduct constitution.The third part analyzes the meaning and feature of constitution implementation and the enlightenment which is from the develpoment experiment of developed countries and which is helpful for our country to improve constitutional implementation.The fourth part studies the present situation of how the constitution is carried out in China.The fifth part puts forward some suggestions on how to perfect the mode of constitution enforecement in our country.
