A Study On The Guarantee Of Litigation Rights Of Prison Sentences

China's traditional mode of thinking,thousands of years the concept of voluntary standards,the development of the power of the cause of a great obstacle to the prison prisoners,it can be said that greater resistance.The existing problems on the protection of the rights of prisoners in China are mostly concentrated in the protection of substantive rights,and there is little involvement in the protection of procedural rights.In this paper,the case of personal practice as a clue to the prison in China prisoners litigation rights protection issues.The article is divided into four parts.The first part is the elaboration of the basic theory.This paper mainly elaborates the meaning and characteristics of the litigation rights of prison inmates,and then points out the present situation of the litigation rights of prisoners in China,and paves the way for further research.The second part focuses on the obstacle factors of the realization of the litigation rights of prisoners in China,and points out the factors that prevent the prisoners from exercising the litigation rights.The third part of the relevant experience for foreign countries to elaborate,as mentioned later put forward our strategy to pave the way.In the fourth part,the author puts forward the corresponding countermeasures,the comprehensive analysis of the paper and the successful experience outside the domain,and discusses the suggestions from the three aspects of concept building,right perfect,facilities and talent construction.
