| Blacklist system as the carrier of dishonesty disciplinary mechanism,is an important part of social integrity system.This system originated in the west,after hundreds of years of history,the connotation of the system is continuously enriched,which regulate the good effect on the behavior of market players and play an important role in promoting for the improvement of social civilization.The system has been introduced into China as a foreign product.As a new management method,it has been used in the management of many industries in our country and has become an important part of our social governance system.Dangerous goods transportation blacklist system that this paper intends to study is the important branch of civil aviation integrity system,is an important period of innovation management of the civil aviation administrative organ in the social transformation,is the inherent requirement for the construction of civil service type government,but also is an inevitable choice to implement the "safety" and "sincere service" bottom line requirements.This article starts from the present situation of the laws and regulations on the air transportation of dangerous goods in China,and points out that there is no regulation on the "blacklist" system in the air transportation regulations of dangerous goods in China.Then the definition of air transport of dangerous goods "blacklist" system are summarized,and the analysis of the air transport of dangerous goods "blacklist" system,the legal nature of the specific administrative act and legal basis for the implementation of the system.In addition,we draw lessons from experience of the United States,the European Union and China's other industries to implement the "blacklist" system.Finally,the conclusion is: the legal attribute of the "blacklist" system of air transportation of dangerous goods is administrative punishment and the legal basis for its implementation shall be legal and administrative regulations. |
