The Research Of Organizing Offender Of Aviation Crime

Organizing offender is a type of offender in a common crime,and the international community is increasingly aware of the importance of organizing offender in aviation crime,the behavior of organize and direct the aviation crime began to be regulated in the International Civil Aviation Criminal Law Convention.Because organizing offender is not be regulated clearly as a type of common crime in the Criminal Law of the People 's Republic of China as Russian Federation Criminal Code,there is controversy about the scope of the existence of the organizing offender in academia.The organizing offender is punished as the perpetrator behind the perpetrator in Germany,and the organizing offender is punished as the collusive co-principal offender in Japan,while the organizing offender is punished as the conspiracy in America,what's more,the Guidelines Manual directly regulates to increase penalties for the organizer.By comparing the provisions of the organizing offender in these states,we can see that the organizing offender that the international civil aviation criminal law conventions regulates can be resolved in these countries.However,the organizing offender is not clear in our country,and the scope of the existence of the organizing offender is limited,all organizing offender in aircraft crime can not be solved.Therefore,drawing on the provisions of the organizing offender in different countries,as well as the provisions of the organizing offender in the International Civil Aviation Criminal Law Convention,study the organizing offender of our country in aviation crime,in order to connect with the international conventions and resolve all the organizing offender in aviation crime.In this paper,the comparative research method,historical analysis method and literature research method are used in the research process.The first chapter mainly summarizes the research contents,methods and innovations of the article.The second chapter elaborates on the concept of aviation crime,the concept and nature of organizing offender,the existence scope of organizing offender and the concept and characteristics of organizing offender in aviation crime.The third chapter discusses the organizing offender in the international civil aviation criminal law through the historical analysis and comparative study.The fourth chapter mainly analyzes the regulation of the organizing offender in Russia,Germany,Japan,the United States and other countries.The fifth chapter analyzes the legislation of our country about the organizing offender in aviation crime and puts forward some suggestions.
