Comparative Research On Legal System Of General Aviation Emergency Rescue

Since general aviation had advantages of rapid,efficient and less restricted by geographical spatial,they had become the world widely effective means in public emergency rescue area.China is a vast area and large population country with frequent disaster which is urgent to establish general aviation emergency rescue system.In view of the fact that there are no specific rules for the general aviation emergency rescue,this article will has certain theoretical significance for further improved and make up the legal blank of domestic general aviation emergency rescue legislation.Analysis the present statue both form legal and practical of general aviation emergency rescue in our country.Through comparing with world general aviation emergency rescue legislation,points out the deficiency existing in general aviation emergency legal system in our country.Through the combination of theory and practice method to analysis emergency rescue mode and organization abroad on the basis of the legislation situation.Pointed out the advantages and disadvantages between typical modes and organizations which are under different legislation framework,put forward the legal status of main body of new mode in China.Finally,aiming at the existing legislation in general aviation legislation problems such as low level,legislation lags behind with the status quo of emerging mode of our country,put forward suggestions of perfecting our country's general aviation emergency rescue system and construction ideas.Such suggestion and ideas came our from the mature experience of foreign legal system which based on perspective of legal system,mode and regulatory of general aviation emergency rescue.Combined different foreign countries practice of legislation and organization of general aviation emergency rescue,this article not only promote the convergence of domestic law and international law,but also has a certain significance for put the level of general aviation emergency rescue further into line with international standards.
