| For a long time,the railway transport industry has always been an important industry related to the national economy and social development of a country.The traditional theory holds that the railway transportation industry belongs to the natural monopoly industry and is therefore not subject to the monopoly law.However,with the development of relevant theory,I gradually applied to the railway transport industry antitrust law.In 2008,China adopted the "anti‐monopoly law",the introduction of the law means that China’s legal system gradually be improved and improved,but this did not change the railway transport industry has a monopoly,monopoly,inefficient;legislation lag,Lack of application;anti‐monopoly law enforcement agencies and improper improper transport price formation mechanism and other issues still exist.At present,China’s railway transport industry is in the transition period of anti‐monopoly law,to make this industry as soon as possible on the road of sustainable development,improve the orderly nature of the railway transport industry,the full realization of the reform objectives,to break the monopoly situation,the establishment of a competitive Characteristics of the market,so the use of the monopoly of the regulation of the industry is facing many difficult problems,we must clearly understand that this is a long battle,must be guided by the legal level and support and the improvement of the system In order to carry forward and regulate.Therefore,it is necessary to carry out in‐depth analysis and research on the application of antitrust law to China’s railway transport industry.This paper is composed of four parts,the first part,expounded the railway transport industry applicable antitrust law theory,and China’s railway transport industry qualitative.In the second part,firstly,it analyzes the history of the change in the domestic railway transportation industry,reveals the problems behind the monopoly situation of the industry,and expounds the importance of restricting and regulating the industry through the antitrust law.The third part compares the history and current situation of the railway transportation industry in other countries,and summarizes the relevant successful experiences.The fourth part,on the basis of the above research,from the promotion of "separation of network transport",improve the anti‐monopoly legal system,improve the anti‐monopoly law enforcement agencies,improve the price formation model,participate in the free trade agreement "competitive neutrality" Out of the railway transport industry applicable anti‐monopoly law related countermeasures. |
